Section 338 of the Tariff Act of 1930: Tariffs of up to 50% against discriminatory countries—an option specifically promoted by advisors as "Plan B" because it is a legal tool, though it has never been used before.
Trump's advisors indicate that the tariffs will not end and will continue through alternative means. These strategies will be adapted based on the court's decision. If the court rules against it, the return of billions of dollars in tariffs collected by the US could be on the table, but the Trump team is focused on backup plans to prevent this.
