Directly betting on B, Elon Musk's lawsuit is unwinnable.
To put it simply, OpenAI has already completed all compliance procedures, and both the nonprofit and commercial phases were approved by the board.
Now Musk is talking about "original intentions," but that argument doesn't hold water.
Even if public opinion favors him, it's very difficult to overturn established facts in court.

I bet on B, and Elon Musk is unlikely to win this lawsuit.
The core reasons are twofold:

1. From a legal perspective, OpenAI has already completed its transition from a non-profit to a for-profit entity, and has obtained approval from shareholders and the board multiple times, with virtually no obvious procedural flaws.

2. From a factual standpoint, when Musk participated in founding OpenAI, there were no clear legal restrictions on its commercialization path; relying solely on moral accusations of "betraying the original intention" is unlikely to hold up in court.
This lawsuit is more like a public opinion battle rather than a legal fight where one can turn the tide.
